The DR Horton Home of Your Own House Raffle is being conducted El Ranchito de los Niños, Inc. – a non-profit organization organized under the laws of the state of New Mexico.

1. The purchase price of a raffle ticket is $75. Checks or money orders should be made out to El Ranchito de los Niños. The IRS has declared that raffle purchases for valuable prizes are not tax-deductible contributions. Cash, Money Orders, MasterCard, Visa, Discover and American Express are accepted.
   
   Ticket purchases may be made several ways:

In the event an entrant’s check or credit card is dishonored by the bank or credit card company, the entry is declared invalid and will be withdrawn from the drawing.

2. Entrants must be 18 years or older and have a valid Social Security Number to purchase or be included in the drawing.
    
3. All completed registration forms must be received with full payment no later than 5 pm on November 11, 2008 or before a total of 4000 tickets are sold, whichever comes first. El Ranchito de los Niños reserves the rights to extend ticket sales, at its discretion until the drawing on November 18, 2008 at 11 am.
    
4. Prizes: The Grand Prize is a DR Horton Santa Barbara Plan home located at 2704 Violeta Circle in the Master Planned Community of Toscana II in Rio Rancho, New Mexico. First Prize is $10,000. Second Prize is $5,000. 3rd-5th prizes are $1,000 each. 6th-9th are $500 each. 10-20th are $250 each and 21-100 prizes are $100 each.
    
5. Drawing – All prizes will be awarded through a random drawing to be held on Sunday, November 16, 2008 at 11 am, at 2704 Violeta Circle in Rio Rancho, New Mexico. Winners need not be present to win. All winners will be notified via phone and mail within 7 days of the drawing. Winner’s names and winning ticket numbers will also be posted on the El Ranchito de los Niños website for 30 days from the drawing date. A copy of these rules and winners names and numbers may be requested by sending a self-addressed envelope to El Ranchito de los Niños, PO Box 2400, Los Lunas, NM 87031.
    
6. Odds – If all 4000 tickets are sold, the odds of winning a prize is 1 in 40. If all 4000 tickets are sold, the odds of winning the Grand Prize is 1 in 4000.
    
7. All Prize winners are responsible for any and all local, state, federal taxes. The Internal Revenue Service requires that any prizes valued of $600 or more be issued a W-2G Form. The Internal Revenue Service also requires that 25% be withheld for Federal taxes, on prizes of $5000 or more.
    
8. The Grand prize winner will have the opportunity to choose the home or $100,000 cash. They must choose their prize in writing by 4 pm on December 3, 2008. The Grand Prize winner will execute a purchase agreement for the home with El Ranchito de los Niños.
    
9. The Grand Prize winner will assume and pay for any and all closing fees, local, state and federal taxes. El Ranchito de los Niños is not held responsible for any express or implied warranties in regarding this prize. All terms, conditions and warranties of the home are between the winner and DR Horton as laid out in the purchase agreement.
    
10. For the last four years, we have given away the grand prize. In the unlikely event that less than 3,000 tickets are sold, ticket purchases will be refunded and all prizes will be withdrawn.
     
11. All prizes must be claimed no later than 5 pm on January 6, 2009. Any prizes unclaimed after that date will constitute and be transferred as a donation to El Ranchito de los Niños.
     
12. El Ranchito de los Niños, its Board of Directors, D.R. Horton and its agents assume no liability for lost, late, misdirected, mutilated, incomplete, illegible, or entries without complete payment which will be deemed invalid and disqualified.
     
13. In the event that more than one name or group of individuals are listed on the winning ticket, the first name listed will be deemed the winner. It is the sole responsibility of the winner to allocate any such prize to other participants in the multiple parties listed.
     
14. Board members, employees and volunteers of El Ranchito de los Niños, employees and agents of D.R. Horton, and immediate family members of any of the above are not eligible to participate in this drawing and any tickets purchased by such and or entities will be void.
     
15. Grand Prize winner understands, acknowledges and agrees that he/she is receiving a prize and will hereby release and discharge El Ranchito de los Niños, DR Horton and any additional sponsors, their employees, agents, officers, directors, and legal representatives and assigns from any and all claims, liabilities, damages, losses or expenses arising from or caused by the award of such a prize including, but not limited to, the payment of any and all taxes that are due.
     
16. The decisions of El Ranchito de los Niños are final on all matters concerning the raffle.
     
17. Void where prohibited.
